Brazil officially implements unified technical regulations for LED lamps and lighting electrical products

On May 5, 2026, Brazil officially submitted a notification G/TBT/N/BRA/609/Add. 6 to the WTO, approving the "Uniform Technical Quality Regulations" for LED (Light Emitting Diode) technology lamps and lighting appliances. At the same time, corresponding conformity assessment requirements were established, as well as conformity marking specifications presented in the form of the National Energy Conservation Label (ENCE). The three contents constitute Annex 1, Annex 2, and Annex 3 of the decree, respectively.
The announcement shows that Decree No. 231/2026 replaces the previous Decree No. 69/2022, and its various parameters will be gradually implemented in stages over 18 months. The new regulations cover a wider range of lighting appliances used in industrial, commercial, and residential sectors, marking a systematic integration and upgrade of Brazil's lighting industry regulatory system.
This regulation does not cover all LED lighting products in a one size fits all manner. According to public regulations, LED lamps, fixtures, hoses or colored lights used for Christmas decoration lighting, as well as lighting decoration dolls, and general or decorative lamps designed to be used with interchangeable light bulbs and sold without any light source, are all listed as applicable exceptions; In addition, LED lamps specifically designed for installation on streetlight poles, covering roads, squares, and other outdoor areas, as well as LED lamps already covered by other specialized regulations of Inmetro, are also not within the scope of this rule. This means that municipal road lighting still follows the previous specialized regulation system.
In terms of compliance management, the new regulations continue and strengthen the import control mechanism. LED lamps and lighting appliances subject to this regulation will be subject to a non automatic import permit system. Importers must apply for a permit from Inmetro in accordance with Decree No. 137/2022 (or its alternative provisions) and complete the relevant procedures within the deadline specified in Article 15 of the decree. The date of shipment of the goods in the country of origin will be used as the basis for calculating the deadline. In terms of market supervision, relevant products will be subject to market supervision actions by Inmetro and public legal entities that have signed commission agreements with it throughout Brazil. Any act or omission that violates the provisions of this law constitutes an illegal act and may be subject to corresponding penalties under Law No. 9933/1999.
