Consumer Product Testing Services - REACH Restricted Substances Section

The REACH restriction list or Annex XVII (ANNEX XVII) helps protect human health and the environment from the risks posed by chemicals by restricting the manufacture, use, or release of certain substances (currently updated to Article 76) on the EU market. These restrictions can apply to the entire substance, mixtures of which the substance is a part, or items containing the substance.

The process of adding substances to the restricted list involves several steps. Usually, a substance is already on the REACH authorization list before being restricted by member states or the European Chemicals Agency (ECHA) at the request of the European Commission. In order to provide sufficient advance notice to the industry and relevant parties regarding potential restrictions, this intention is announced through the intention registration office and posted on the ECHA website. This step helps stakeholders to prepare for the possibility that they may need to comply with the constantly changing requirements of REACH regulations.

The REACH Restriction List (Annex XVII) is an important component of the European Union's Regulation on the Registration, Evaluation, Authorization and Restriction of Chemicals (REACH Regulation), aimed at restricting the manufacture, use or market release of certain hazardous substances to protect human health and the environment. The following is a detailed explanation of the REACH restriction list:

1. Overview of REACH restriction list
Name: REACH Annex XVII.

Content: Listed restricted substances, mixtures, or items and specified their restrictions.

Purpose: To reduce the harm of harmful substances to human health and the environment by restricting their use.

Update: As of the latest version, the restriction list contains a total of 76 entries.

2. Scope of restrictions
The restrictions in the restriction list can be applied to the following situations:

Substance itself: Restricting the manufacture, use, or market release of certain chemical substances.

Mixture: Restrict the use or placement of mixtures containing certain substances on the market.

Item: Restrict the use or placement of items containing certain substances on the market.

3. Examples of restricted substances
The following are examples of some common substances in the restricted list:

Asbestos: Prohibited from use in most products.

Cadmium and its compounds: restricted use in plastics, coatings, and batteries.

Nickel and its compounds: limited release in items that come into direct contact with the skin.

Polycyclic aromatic hydrocarbons (PAHs): limit their content in tires, plastics, and rubber products.

Phthalates: restricted use in toys and children's products.

Perfluorooctane sulfonic acid (PFOS): limited to use in textiles and fire foam.

4. Update process of restriction list
The process of adding substances to the restricted list includes the following steps:

Proposal: Restriction proposal proposed by EU member states or the European Chemicals Agency (ECHA).

Intention registration: Publish intention registration on the ECHA website to notify the industry and relevant parties.

Public Consultation: Conduct public consultations and collect opinions from stakeholders.

Risk assessment: ECHA's Risk Assessment Committee (RAC) and Socio Economic Analysis Committee (SEAC) evaluate proposals.

The European Commission has decided whether to include a substance in the restricted list based on the assessment results.

Implementation: The restrictive measures will take effect after they are published in the official EU gazette.

5. Corporate Responsibility
(1) Compliance testing
Enterprises need to use chemical analysis (such as GC-MS, LC-MS, etc.) to detect the content of restricted substances in their products.

Ensure that the product meets the requirements of the REACH restriction list.

(2) Technical documents
Prepare complete technical documents, including test reports, material lists, usage instructions, etc.

Ensure that the product complies with the requirements of REACH regulation.

(3) Labels and identification
If the product contains restricted substances, relevant information must be indicated on the label.

Provide instructions for use, including applicable conditions, safety precautions, etc.

(4) Supply Chain Management
Convey relevant information about restricted substances downstream in the supply chain.

Ensure that the raw materials provided by suppliers comply with the requirements of REACH regulations.

6. Punishment and Legal Responsibility
If the product does not meet the requirements of the REACH restriction list, it may face penalties such as fines, product recalls, or market bans.

Manufacturers and importers are legally responsible for product compliance.

7. Summary
The REACH restriction list (Annex XVII) is an important component of the EU REACH regulation, aimed at restricting the use of hazardous substances and protecting human health and the environment. Enterprises need to closely monitor the updates of the restriction list, fulfill their responsibilities for compliance testing, technical document preparation, and supply chain management, ensure that their products comply with the requirements of REACH regulations, and avoid legal risks.
