Germany lfgb

In September 2005, the German Food and Dietary Products Law LFGB replaced the Food and Daily Necessities LMBG. It is also known as the "Food, Tobacco Products, Cosmetics, and Other Daily Necessities Management Law", which is the most important basic legal document in Germany's food hygiene management. It is the guideline and core for the formulation of other specialized food hygiene laws and regulations. In general, the testing items under Articles 30 and 31 of the LFGB German Food and Daily Necessities Act include sensory evaluation of odor and taste transfer, comprehensive migration in different food simulants, specific migration of a certain substance in different food simulants, testing of composition and heavy metals that can be precipitated, testing of transferable or volatile organic compounds, and inspection of chemical hazardous substances according to the German Chemicals Act. The regulatory requirements are detailed as follows:

1. Shaped products/complete machine LFGB 30&31
2. Polyethylene (EU) No 10/2011&BfR Recommendation III
3. Polypropylene (EU) No 10/2011&BfR Recommendation VII
4. Polycarbonate (EU) No 10/2011&2011/321/EU
5. Polystyrene (EU) No 10/2011&BfR Recommendation V&VI
6. Acrylonitrile Polymer (EU) No 10/2011&BfR Recommendation L&VI
7. Polyamide/Nylon (EU) No 10/2011&BfR Recommendation X
8. Polyethylene terephthalate (EU) No 10/2011&BfR Recommendation XVII
9. Silicone BfR Recommendation XV
10. Ceramic/Enamel/Glass DIN 51032
11. Various types of stainless steel/iron products/metals/alloys/electroplated products LFGB 35B 80.03-1/2
12. Non stick coating BfR Recommendation LI
13. Rubber BfR Recommendation XXI

The German Food and Daily Necessities Act (LFGB) is the most important basic legal document in the field of food hygiene management in Germany, replacing the previous Food and Daily Necessities Act (LMBG). LFGB covers the management of food, tobacco products, cosmetics, and other daily necessities, and is the core regulation of Food Contact Materials (FCM) in Germany. The following is a detailed explanation of LFGB regulations:

1. Overview of LFGB regulations

LFGB, also known as the Food and Daily Necessities Act, is the fundamental law for food hygiene management in Germany.

Scope of application: Applicable to all materials and products in contact with food, including plastics, rubber, metals, ceramics, glass, paper, and cardboard.

Core provisions: Articles 30 and 31 of LFGB are the main testing criteria for food contact materials, which stipulate the safety and testing requirements of the materials.

2. Main testing items

According to Articles 30 and 31 of LFGB, the testing items for food contact materials include:

(1) Sensory testing

Sensory evaluation of odor and taste transfer:

Check if the material has any adverse effects on the odor and taste of the food.

Testing is conducted through artificial sensory evaluation or instrumental analysis.

(2) Comprehensive migration testing

Comprehensive migration in different food simulation solutions:

Measure the total amount of all transferable substances in the material to ensure compliance with the overall migration limit (OML).

Common food simulants include water, 3% acetic acid, 10% ethanol, and olive oil.

(3) Specific migration testing

Specific migration of a specific substance in different food simulation solutions:

Detect the migration amount of specific chemicals (such as plasticizers, monomers, heavy metals, etc.) in the material to ensure compliance with specific migration limits (SML).

(4) Heavy metal testing

Composition and testing of heavy metals that can be precipitated:

Detect the migration of heavy metals such as lead, cadmium, nickel, and chromium in materials to ensure compliance with the limit requirements of Germany and the European Union.

(5) Organic compound testing

Transferable or volatile organic compound testing:

Detect transferable or volatile organic compounds in materials (such as solvent residues, plasticizers, etc.).

(6) Chemical hazard substance testing

According to the German Chemicals Act, chemical hazardous substances are tested:

Check whether the material contains chemicals prohibited or restricted by German chemical laws.

3. Labeling and identification requirements

The product must be labeled with the label of "food contact material" or "suitable for food contact".

Please provide instructions for use, including applicable temperature range, cleaning methods, etc.

Manufacturer information, batch number, and production date need to be labeled.

4. Punishment and legal responsibility

If the product does not meet the requirements of LFGB, it may face penalties such as fines, product recalls, or market bans.

Manufacturers and importers are legally responsible for product compliance.

5. Precautions for exporting to Germany

Compliance testing: Ensure that the product passes the sensory testing, migration testing, heavy metal testing, and organic compound testing required by LFGB.

Technical documents: Prepare complete technical documents, including test reports, material lists, design drawings, etc.

Labels and Instructions: Ensure that product labels and usage instructions comply with LFGB requirements.

Certification and Marking: Ensure that products are marked with the CE mark and comply with specific requirements in Germany.

6. Summary

LFGB is the core regulation for the management of food contact materials in Germany, which imposes strict requirements on the safety, chemical migration, and sensory performance of materials. Food contact material products exported to Germany must not only comply with the requirements of EU Regulation (EC) No 1935/2004, but also meet specific requirements of LFGB. Manufacturers and exporters need to pay special attention to the chemical safety, migration limits, and sensory performance of materials to ensure product compliance.
