California Department of Justice releases first tasteless tobacco list

According to Congressional Bill AB 3218, California Attorney General Rob Bonta has released the first Unscented Tobacco List (UTL), which is a list of odorless tobacco products legally sold under California's flavored tobacco restrictions.
UTL regulatory background
In 2020, Senate Bill SB 793 prohibited flavored tobacco products and flavor enhancers in tobacco products in California.
AB 3218 came into effect on January 1, 2025, and revised the seasoning ban by expanding the definition of seasoning products, enhancing enforcement powers, and creating a seasoning ban.
UTL application deadline
Tobacco manufacturers and importers are required to submit a complete application before October 9, 2025.
UTL applicable products
1. Tobacco and nicotine products: Any product containing or derived from tobacco or nicotine (including synthetic nicotine, nicotine alkaloids, and nicotine analogues) intended for human consumption.
2. Electronic delivery system: a device that delivers nicotine or vapor liquid into the inhaler's body, such as an electronic cigarette or vapor. Note: Devices that do not contain nicotine or liquids are not within the UTL range.
The following products are exempt from California flavored tobacco restrictions and do not need to be listed in UTL:
1. hookah: Tobacco is smoked in hookah or hookah pots, including Maassel and Narghile.
Note: Seasoning hookah is only partially exempted and can only be sold at licensed tobacco retailers that restrict entry for individuals aged 21 and above.
2. Loose leaf pipe tobacco: Tobacco is tobacco that is cut or chopped into pipes (usually sold in bags).
Attention: Homemade cigarettes do not enjoy exemption treatment.
3. Premium Cigars: To be recognized as a "premium" cigar, one must:
a. Handmade production (non mechanized mass production);
b. The packaging is entirely made of whole tobacco leaves;
c. Sealing is done manually;
d. The wholesale price should be at least $12;
e. Does not contain filters, cigarette butts, or non tobacco suction tips.
law enforcement
Any protected tobacco product that does not appear on UTL is considered a flavored tobacco product and is not eligible for sale. If not registered and included in UTL, manufacturers and retailers will be warned, and products will face seizure and punishment by law enforcement agencies.
