The European Commission has the right of initiative to create policies and laws.

Since the European Commission proposed on July 28, 2023 to replace the Toy Safety Directive 2009/48/EC (TSD) with a Toy Safety Regulation, this proposal/draft has undergone multiple discussions, revisions, and additions and is currently in the first reading stage of the European Parliament (EP) and the Council of the European Union.

At present, the law regulating EU toys is still the Toy Safety Directive.

Note 1: Regulations and directives are two different legal acts of EU secondary law. among

The characteristic of the regulation is that once it comes into effect, it automatically applies uniformly to all EU countries without the need to be converted into national law. They have overall binding force on all EU countries.

The characteristic of the directive is that it requires EU countries to achieve certain results, but allows them to freely choose how to implement them. EU countries must take measures to incorporate it into national law (transposition) in order to achieve the goals set forth in the directive. National authorities must communicate these measures to the European Commission.

Note 2: From the difference between regulations and directives, it can be seen that the EU's requirements for toys are more uniform at the level of the EU single market.

CE mark on toys

Due to the fact that the Toy Safety Directive is the first departmental directive to be included in the general framework for the marketing of products in the European Union and aligned with it - i.e., consistent with or based on the reference clauses of the New Approach directives and the New Legislative framework - toys placed in the European Economic Area (EEA) are required to carry the CE mark.

Presumption of conformity

According to the requirements of the new directive, the legislative content should be limited to "essential requirements" and technical details should be left to European harmonized standards. That is, directives and regulations that match CE should be drafted by the European Commission based on the needs of the three major European standardization organizations (the European Standardization Organizations, ESOs) CEN, CENELEC, or ETSI. The "technical details" should be specified and approved by the standardization organizations before being reviewed and decided by the European Commission in the Official Journal of the European Union (OJEU). Published on.

The coordinated standards published in the official gazette of the European Union are voluntary standards that can be referenced to demonstrate compliance with corresponding directives and regulations, and can be used as a presumption of conformity.

Coordination standards for toys

The EN 71 series standards are a set of standards drafted by CEN for various types of toys that meet the definition and can be used to demonstrate compliance with the Toy Directive.

EN IEC 62115 is the IEC standard adopted and transformed by CENELEC, which is used to demonstrate compliance with the Toy Safety Directive and the Coordinated Standard for Electrical Toy Safety.

The following is information on the coordination standards related to the Toy Safety Directive:
