The amendments to Chapter 2, Chapter 2 (Construction - Fire Prevention, Fire Detection and Extinguishment) of SOLAS and the 1994 and 2000 International Safety Code for High Speed Craft (HSC Code) prohibit the use or storage of fire extinguishing media containing perfluorooctane sulfonate (PFOS). The new regulations will officially come into effect on January 1, 2026.

1、 What is PFOS

PFOS refers to perfluorooctane sulfonic acid (PFOS), its salts, and perfluorooctane sulfonyl fluoride (PFOS).

PFOS is widely used in various products due to its surface activity characteristics and surface resistance/repellency to oil, water, grease, or dirt. PFOS is commonly used in electrical and electronic components, fire extinguishing foam, optical imaging, hydraulic oil, leather, paper and textiles.

2、 The hazards of PFOS

Research has found that Arctic animals such as polar bears, seals, bald eagles, and minks, tropical organisms, birds, and fish all exhibit significant concentrations of high biological accumulation of PFOS. The toxic effects of PFOS on the human body mainly affect the liver, kidneys, thyroid, and fertility, thereby inducing cancer. Due to its long-term accumulation, humans, wildlife, and the environment are continuously exposed to this substance.

The core purpose of this amendment is to protect crew members from the risk of exposure to hazardous substances during firefighting operations, while reducing the negative impact of harmful firefighting media on the ecological environment.

3、 New requirements for fire extinguishing media

According to SOLAS Regulation II-2/10.11 and Chapter 7.9 of 1994/2000 HSC regulations, "fire extinguishing media" includes fire foam, and the use of fire foam containing perfluorooctane sulfonate (PFOS) is explicitly prohibited.

'Contains perfluorooctane sulfonate (PFOS)' refers to a concentration of perfluorooctane sulfonate exceeding 10mg/kg (0.001% by weight). At the same time, the regulations require that the fire extinguishing media containing such foam, after being removed from the ship, must be sent to the corresponding shore based reception facilities for proper disposal.

4、 Scope of application and execution nodes

New shipbuilding: Ships/high-speed boats built on or after January 1, 2026 are subject to the ban from the time of construction.

Existing ships: Ships built before January 1, 2026 must comply with the ban on or after the first inspection date of January 1, 2026.

5、 Compliance Action Process

Shipowners, crew members, and captains must be aware of the regulation prohibiting the use or storage of fire extinguishing agents containing perfluorooctane sulfonate (PFOS); And timely obtain the manufacturer's statement or laboratory test report to confirm that the foam concentrate meets the new requirements.

If there are fire extinguishing agents containing PFOS on board, timely measures must be taken to remove or replace them before January 1, 2026.

The declaration of foam manufacturer shall include information about foam, such as but not limited to foam type, production cycle, batch number, and relevant reference of type approval/marine equipment directive certificate of foam.

For fire extinguishing media installed before January 1, 2026, if a manufacturer's statement or laboratory test report cannot be provided, it should be required to sample and test the fire extinguishing media on board according to recognized standards.

If it is impossible to obtain the statement that the foam manufacturer does not contain PFOS, or to prove that the foam extinguishing agent on board does not contain PFOS through sampling inspection, the foam extinguishing agent should be removed from the ship and sent to the corresponding shore based receiving facilities for proper disposal.
