2026 Regulatory Panorama: A Comprehensive Overview of the Upcoming Federal Regulations

License is a mandatory requirement: applicable to manufacturers and importers
◆ Cost and cycle: Every 5 years, a fee of $120000 is required for each warehouse replacement.
Penalty for operating without a license: The maximum fine can be up to $50000, and the maximum sentence is up to 5 years of confiscation of products, raw materials, and equipment.
New licensing requirements for wholesale and retail (USD)
1. Wholesale License
1) 5-year validity period, with a fee of $10.000;
2) Suitable for wholesale companies: retail chains with centralized warehousing or internal allocation; And manufacturers/importers who purchase third-party products for resale.
2. Retail License
1) $250 per store per year;
2) The longest is 5 years. Applicable to all legal entities and individual businesses engaged in retail procurement, storage, and sales of tobacco and nicotine products.

Electronic cigarette e-liquid and new technology standards for ENDS tobacco
◆ Liquid capacity limitation
1. Bottled up to 30mL;
2. A maximum of 10mL of disposable electronic cigarettes (ENDS);
3. The maximum capacity for packaging units (such as cartridges and warehouses) is 2mL.
Requirements for disposable electronic cigarettes (ENDS)
1. The power adapter and USB cable can only be included with the product and must meet all technical requirements;
2. A user manual must be provided, clearly indicating the device model;
3. It is prohibited to attach any components that turn disposable electronic cigarette (ENDS) devices into electronic games or portable communication devices.
