The California State Attorney's Office will issue Bill AB-3218 in 2024, implementing the Unfavorable Tobacco List (UTL) system, which will be announced by December 31, 2025.

1. Product scope:

Electronic cigarettes, electronic pipes, electronic hookahs, cigarettes, cigars, small cigars, chewing tobacco, pipe tobacco, and snuff.

2. Applicant:

Manufacturers and importers

3. Purpose of application: The applicant shall submit to the Attorney General a list of all branded tobacco products manufactured/imported for sale or distribution in California, indicating that these tobacco products lack distinctive flavors.

4. Application fee:

The initial application fee for each brand style is up to $1000.
Annual renewal fee of up to $1000 per brand style.


5. Application requirements:

a. Separate applications for each brand style, category, and style;

(Brand style "refers to a tobacco product style within a brand that is distinguished from other styles of the brand by weight, volume, size, common product code, inventory unit, nicotine content, characteristic flavor, logo, symbol, motto, label, marketing, materials, packaging, or other product identification marks.)

b. Prove that each brand style lacks distinctive flavors.

c. Manufacturers or importers should provide additional information and factual evidence regarding the lack of distinctive flavors in their brand style.

d. Manufacturers or importers should provide additional information and documents regarding the status, packaging, or brand style marketing of tobacco products.

6. Any product not listed on UTL shall be considered as flavored tobacco product. Any product not listed on UTL is not eligible for market access in California.

7. Manufacturers and importers shall submit the latest information to the Attorney General before no longer manufacturing/importing and selling products listed on UTL in California, or before manufacturing or importing products with distinctive flavors.

The California State Prosecutor's Office will issue a UTL before December 31, 2025.
