News | EU POPs approves relevant draft on UV-328 and PFOA

On May 5, 2025, the European Commission adopted a proposal to revise Appendix I of the EU POPs Regulation, which will soon release revised regulations on adding UV-328 and revising PFOA and salt and related substance control requirements. Enterprises need to prepare in advance, promptly investigate relevant materials, and confirm the compliance of products.
The main contents of the revised draft passed are as follows:

Add UV-328 control content
2- (2H-Benzotriazol-2-yl) -4,6-di-tert-butylphenol (UV-328)
CAS No：25973- 55-1 EC No：247-384-8
Main control requirements:
For the purpose of this article, point (b) of Article 4 (1) applies to substances, mixtures, or articles with UV-328 concentrations equal to or lower than 1mg/kg (0.0001% by mass).
2. As an exception, items containing UV-328 may be placed on the market and used in the following situations:
(a) Used in land motor vehicles, allowed until February 26, 2030;
(b) Mechanical separator used in blood collection tubes, allowed until February 26, 2030;
(c) The cellulose triacetate film used in polarizing films is allowed until February 26, 2030;
(d) Used in photographic paper, allowed until February 26, 2030;
(e) The spare parts of the following equipment, if they were originally produced using UV-328, are allowed to be used until the end of their service life or until 2044, whichever is earlier:
(i) Land motor vehicles;
(ii) Fixed industrial machinery used in agriculture, forestry, and construction;
(iii) LCD display devices used for analysis, measurement, control, monitoring, testing, production, and inspection, except for medical equipment;
(f) The spare parts of the following equipment, if already in use with UV-328 during production, are allowed to be used until the end of their service life:
(i) LCD displays in equipment that comply with Regulation (EU) 2017/745 and Regulation (EU) 2017/746;
(ii) LCD display devices used for analysis, measurement, control, testing, production, and inspection.
3. Articles containing UV-328 that have been used within the European Union before or on the expiration date of the relevant exemptions specified in paragraph 2 (a) to (f) may continue to be used.

Revise PFOA control requirements
Revise the fourth column of the entry "Perfluorooctanoic acid (PFOA), its salts, and related compounds" in Part A of Appendix I of the POPs regulations as follows:
Revision 3: The second sentence "The European Commission shall review and evaluate the exemption before August 25, 2023" has been deleted.
Add points 4a and 4b.
4a: Paragraph (1) (b) of Article 4 applies to PFOA or its related compounds containing no more than 10 mg/kg (0.001% by weight) of fire foam and its concentrate, which are used to suppress liquid fuel vapor and extinguish Class B fires. This limit is valid for 3 years from the effective date of the regulation.
4b.: Paragraph (1) (b) of Article 4 also applies to PFOA or its related compounds containing no more than 10 mg/kg (0.001% by weight) in fluorine free fire fighting foam, provided that these compounds are from fire fighting equipment cleaned according to the best available technology.
Revision 6: Replace the date "July 4, 2025" with "December 3, 2025".
Revision 10: The second sentence "The European Commission shall review and evaluate the exemption before February 22, 2023" has been deleted.
Add point 11: Articles containing PFOA, its salts, and PFOA related compounds already in use in the European Union may continue to be used before or on the expiration date of the relevant exemptions specified in points 5 (a) to (d).
