On June 12th of this year, during a hearing on combating the rise of illegal electronic cigarettes in the US Senate, the Food and Drug Administration (FDA) and the Department of Justice (DOJ) were criticized by many senators for not effectively cracking down on illegal electronic cigarettes.

Subsequently, the FDA took frequent actions. At the end of July (July 25th and July 31st), the FDA issued two consecutive "work summaries", showing that it had issued warnings to retailers selling unauthorized electronic cigarettes both offline and online.

On July 25th, the FDA announced warning letters to 80 physical retailers in 15 different states for selling unauthorized electronic cigarette products popular among young people. In addition, the FDA has announced lawsuits against eight other retailers for filing of complaints for civil money penalties (CMPs) - as these retailers have failed to take action after being warned about selling unauthorized e-cigarettes.

On July 31st, the FDA issued warning letters to five online retailers selling unauthorized disposable electronic cigarette products, involving multiple popular brands and well-known retailers.

These warning letters are the result of FDA's continuous monitoring of multiple monitoring systems, including a review of various data, to identify emerging products that are popular or attractive to young people and are particularly noteworthy.

So far, the FDA has issued over 680 warning letters to companies manufacturing, selling, and/or distributing unauthorized new tobacco products, over 690 warning letters to retailers selling unauthorized tobacco products, and filed civil penalty lawsuits against 64 manufacturers and over 140 retailers.

Note 1: The FDA typically issues a warning letter when a violation is first discovered during an investigation or inspection. The recipient of the warning letter has 15 working days to respond to the measures they will take to correct the current violation and prevent future violations. However, if the violations are not corrected in a timely manner, it may lead to additional actions by the FDA, including CMPs.

Note 2: As of now, the FDA has approved 34 electronic cigarette products and devices. The list refers to the FDA's maintenance of the printable flyer of authorized e-cigarettes https://digitalmedia.hhs.gov/tobacco/hosted/E-Cigarettes-Authorized-FDA-JULY2024.pdf
