Sorting out common problems of e-cigarettes in Netherlands

1) Information submission platform

As the Netherlands is one of the 27 member States of the European Union, according to the principle of single market and single notification window, the information about e-cigarettes exported to the Netherlands has also been submitted through the unified platform of the European Union-EU common entry gate or EU-CEG for short.

2) Who is responsible for information submission?

The importer is responsible for submitting the product information to the competent authority that wants to put it on the market.

Importers must ensure that they and their products are identifiable in the EU-CEG system. There are two options:

The importer submits the information by himself.

Importers ask manufacturers to submit information for them. In this case, the relationship must be explained in the "affiliated company" section or the "Nominations Contributor" section.

3) When to submit the information

For electronic cigarettes and supplementary containers with and without nicotine: six months before the scheduled launch date in the Dutch market. Any substantial changes to the product should be resubmitted.

Product sales information of the previous year: submitted every year (no later than June 15th of each year).

After the manufacturer or importer obtains all available internal and external information about user group preferences, product sales forms and market research summary, this information should be submitted to the regulatory body within a reasonable period of time. This period is generally 2 months.

4) Who is responsible for processing information?

In the Netherlands, the National Institute for Public Health and the Environment (RIVM) is responsible for collecting and processing information for the Ministry of Health, Welfare and Sport.

5) How to confirm whether the submitted information is correct and whether the product can be put on the Dutch market?

The EU-CEG system will only feed back whether the information submitted by the submitter has been successfully registered. Will not approve or disapprove the product. RIVM will not give confirmation information about the advertised products, so there will be no publicity list. You can send the name of the submitter company and the corresponding EC-ID to the official mailbox to confirm whether it has taken effect, and the official contact point will reply by email.

6) What is the cost of each product?

According to TPD, member countries can charge a certain percentage of fees to the manufacturers and importers of tobacco products who submit applications for receiving, storing, processing, analyzing and information announcement.

However, from January 1st, 2024, data submission in EU-CEG will no longer be charged, except for TNCO (TAR, Nicotine and Carbon Monoxide) measurement fees.

7) Dutch electronic cigarette taste requirements

In the progress letter of the prevention agreement dated June 22, 2020, in order to further reduce the attractiveness of e-cigarettes and protect young people, the Netherlands will ban all flavors of e-cigarette liquid except tobacco.

From January 1, 2024, electronic cigarettes with flavors other than tobacco will no longer be allowed to be sold in the Dutch market, and taste information will no longer be mentioned on the packaging.

From January 1, 2025, the words related to tobacco (tabak) will no longer be reflected on packaging and smoking utensils. Even e-cigarettes of other flavors that were previously sold need to be disposed of or returned to the manufacturer or importer.

8) Provisions on Zero Nicotine Electronic Cigarette

Where the product is applicable, the regulations for zero nicotine electronic cigarettes and supplementary containers are the same as those for nicotine-containing electronic cigarettes and supplementary containers.
