On August 18, 2025, the extended producer responsibility (EPR) requirements under the new EU battery regulation EU 2023/1542 officially came into effect! This means that manufacturers and sellers of batteries or products containing batteries in EU countries must complete the corresponding country's EPR registration before August 18, 2025, and submit the registration number to e-commerce platforms (such as Amazon, TEMU, etc.) as required, otherwise non compliant products will face the risk of being taken down and banned from sale.

Overview of EU 2023/1542 New Regulations 01

The EU 2023/1542 new regulation replaces Directive 2006/66/EC and applies directly to the entire EU, covering all types of batteries, including:

Portable battery

SLI battery (starting, lighting, and ignition)

Light transportation vehicle (LMT) batteries (such as electric bicycles, scooters)

Industrial batteries

Electric Vehicle (EV) Battery

This regulation aims to ensure that all batteries sold in the EU market are safe, sustainable, durable, and recyclable.

02 Key EPR Requirements

The Extended Producer Responsibility (EPR) requirements that will take effect from August 18, 2025 include:

Register producers in each EU member state where batteries are sold.

Take financial responsibility for the collection, treatment, and recycling of waste batteries.

Label requirements, including:

All batteries should be labeled with a wheeled trash can with a cross mark.

Identification of battery chemical composition (e.g. "Li" represents lithium).

A QR code used to display digital product information.

Separate collection symbols for proper disposal by end users.

These requirements aim to increase collection rates, reduce environmental hazards, and enhance transparency for consumers and recyclers.

03 Other major requirements and schedule

a) Carbon footprint and recycled components

Starting from 2025, manufacturers must disclose the carbon footprint of electric vehicle, industrial, and light mobile power (LMT) batteries.

Starting from 2031, the minimum recycled component standards will apply:

16% cobalt

6% lithium and nickel

85% lead

b) Battery passport

By 2027, the following products will be required to use digital battery passports:

Electric Vehicle Battery

Industrial batteries exceeding 2 kWh

Lightweight Mobile Power (LMT) Battery

This passport must include information on battery performance, composition, and source, and can be accessed through a QR code.

c) Replaceability and security

Starting from 2027, the design of portable batteries must be easy for end-users to replace.

The lightweight portable power bank (LMT) battery must be replaceable by professionals.

04 Waste and Recycling Measures

In order to support recycling and reduce dependence on raw materials, the regulation introduces the following provisions:

The minimum recovery efficiency for key materials such as cobalt, lithium, nickel, copper, and lead.

Update EU waste regulations, including new categories such as' black blocks' generated from broken batteries.

Starting from March 2025, restrictions will be imposed on the export of hazardous battery waste to non OECD countries.

05 Strategic impact on stakeholders

Manufacturers, importers, and distributors must be prepared for the following:

Register national level manufacturers in each EU operating country/region

Implement a compliant labeling system

Due diligence policy for raw material procurement

Establish internal systems to ensure the achievement of recycling and reuse goals

Failure to fulfill these obligations after August 18, 2025 may result in penalties, market access restrictions, or enforcement actions by national authorities.

06 Summary

The EU Battery Regulation (EU 2023/1542) reflects the EU's commitment to environmental sustainability, recyclability, and strategic autonomy in the battery value chain.

With the key Extended Producer Responsibility (EPR) requirement coming into effect on August 18, 2025, stakeholders must take immediate action to ensure that their operations comply with the requirements of the regulation.
