With the establishment of the General Product Safety Regulations (GPSR) as a new standard, the compliance framework for the European market is about to undergo a transformation. GPSR will be enforced on December 13, 2024, replacing the original General Product Safety Directive.
This new regulation has a broad impact on sellers operating on European platforms: products that do not meet GPSR requirements will face the risk of being removed by Amazon once the regulation takes effect. For sellers, this is an urgent warning and a critical moment for compliance preparation. Today, we will answer some key questions about GPSR for everyone.
Which products will be affected by GPSR regulations?
The vast majority of non food consumer goods are subject to the General Product Safety Regulations (GPSR), except for the following types of goods:
Medicines for human or veterinary use;
Food;
Animal feed;
Living plants and animals (including genetically modified organisms and microorganisms for enclosed use, as well as animal and plant products directly related to the future reproduction of animals and plants);
Animal by-products and derived products;
Plant protection products (such as insecticides);
The consumer's ride or travel equipment, provided that the device is directly operated by the service provider within the scope of transportation services provided to the consumer, rather than being operated by the consumer themselves;
Aircraft;
Antiques;
What is the EU leader? What is Oudai?
The EU head refers to a natural person or legal entity specifically designated by a manufacturer located outside the European Economic Area (EEA). It can be a local manufacturer or importer, or an authorized representative (i.e. European representative) designated by the manufacturer or brand within the EU.
When the seller is located outside the EU, the EU authorized representative will represent the seller in fulfilling specific responsibilities required by EU directives and laws for the seller.
Before the effective date of GPSR, can we temporarily ignore it and wait until the end of the year to operate?
No, there are many requirements under GPSR regulations, including uploading and labeling. Sellers usually need 4-6 months to complete these three steps and store products that meet GPSR labeling requirements in Amazon FBA warehouses.
If there are still products in FBA inventory that do not meet the labeling requirements after December 13th, your product may be proactively taken down by Amazon and the non compliant inventory removed.
What information should my product label contain to meet the requirements of GPSR?
GPSR regulations require labels to include:
1) Contact information of the responsible person and manufacturer (name, postal address, email/URL);
2) Product safety and warning information, including CE markings, energy labels, as well as toy safety and chemical hazard warnings (in the language of the country of sale);
3) At least one product type, batch, serial number, or other easily identifiable information for the product.
Where should I stick my label?
Labels can be affixed to products, product packaging, product packages, or accompanying documents. It is also possible to add a QR code/barcode on the label to display the responsible person/manufacturer information, but at the same time, the seller also needs to display the responsible person/manufacturer information in text on the product, product packaging, or accompanying documents.
What does the product type, batch or serial number, or other easily identifiable information in GPSR labeling requirements refer to? Do I need to label everything or just choose one?
Sellers must use product identifiers, such as product type, batch, serial number, or one of other elements, to physically label these products so that customers can identify them.
If I change the information of the EU responsible person, do I need to update the product label and product safety pictures synchronously?
If you change the EU responsible person, you will need to:
1) Update your responsible person information on the seller platform;
2) Display the latest responsible person information on the label;
3) If the product safety pictures/files you have uploaded contain information about the responsible person, you need to update the responsible person information and upload them again.
