The European Commission officially released the General Product Safety Regulation (GPSR) (EU) 2023/988 on May 23, 2023. This regulation officially came into effect on June 12, 2023 and will be enforced on December 13, 2024, replacing the old General Product Safety Guidelines (GPSD, 2001/95/EC). Directive 87/357/EEC and 2001/95/EC shall be repealed from December 13, 2024.

01

What is the General Product Safety Regulations (GPSR)?

The General Product Safety Regulation (GPSR) in Europe is a new regulation aimed at ensuring that all consumer goods in the EU market are safe, and most non food consumer goods sold in the EU and Northern Ireland are required to meet the requirements of this regulation.

GPSR provides a safety net for products or risks that are not regulated by other EU legislation. This secure network feature means that EU consumers are always protected from dangerous products, both now and in the future.

02

New requirements and changes

GPSR is a further revision and improvement of the previous General Product Safety Directive (GPSD), adding new compliance requirements. Specifically, significant adjustments have been made to the product compliance responsible person, product labeling, certification documents, communication channels, and other aspects.

Compared to GPSD, GPSR has increased its requirements for compliance officers, including distributors, authorized representatives, fulfillment service providers, online market providers, and entities other than manufacturers who make significant modifications to products.

One of the biggest changes in the new policy is the mandatory requirement for EU representatives, which means that all sellers of EU products must designate an EU representative to be responsible for complying with GPSR requirements.

03

Which sellers will be affected?

Most Amazon European sellers will be affected by this regulation. This includes the sale of goods in the European Union and Northern Ireland, as well as the sale of non food consumer goods.

Except for the following product types:

Medicines for human or veterinary use;

Food;

Animal feed;

Living plants and animals (including genetically modified organisms and microorganisms for enclosed use, as well as animal and plant products directly related to the future reproduction of animals and plants);

Animal by-products and derived products;

Plant protection products (such as insecticides);

The consumer's ride or travel equipment, provided that the device is directly operated by the service provider within the scope of transportation services provided to the consumer, rather than being operated by the consumer themselves;

Aircraft;

Antiques.

04

How should sellers complete compliance?

Sellers should ensure that all products sold in the EU&Northern Ireland comply with existing labeling and traceability requirements. Sellers need to provide an EU representative for the products they sell.

The following individuals can become EU leaders:

① Manufacturer (if registered within the European Union);

② Importers registered within the European Union;

③ The authorized representative of a company registered within the European Union, designated in writing by the manufacturer or brand as the person in charge;

④ A delivery service provider registered within the European Union responsible for delivering goods.

Ensure that the product label includes the following information:

① Contact information of the EU responsible person (postal address and email address URL);

② Warning and safety information (please use the language of the sales country or region);

③ Label for product type, batch or serial number or other elements;

④ The postal address and email URL of the manufacturer and importer (if applicable), as well as the postal address or email address URL of the single point of contact who can contact them (if different from the above address).

Ensure that the following information is displayed in the online product information (product details page):

① The name and detailed contact information of the EU responsible person, including postal address and email address URL;

② Manufacturer's name and detailed contact information, including postal address and email address URL;

③ In addition to displaying labeling and labeling information that complies with applicable EU product safety and compliance laws, warning and safety information should also be displayed, ensuring that these information are in the language of the selling country or region.
